憲法第一条は「天皇の地位は国民の総意に基く」 と定めているから、
憲法第二条のいう「国会の議決した皇室典範の定め」である 皇室典範「第一章 皇位継承」
は、国民の総意として憲法上確定している。
憲法上確定しているから、皇室典範第一章を変更するには、国会の議決に加えて、憲法改正手続きによる国民投票を行い、新たな国民の総意をつくる必要がある。
